Time does indeed fly! I am already celebrating 1 year of success of my practice since its inception in July 2018.
Huge thank you to all my clients, family and friends for the confidence boost and help in getting this my practice off the ground making it a tremendous 12 months of ground-breaking success.
Five fundamentals which have contributed to success of my practice in the past twelve months are:
• “A customer is the most important visitor on our premises. He is not dependent on us” – M.K. Gandhi.
A client comes first and is the most important person for me. Acting in the best interest of a client and ensuring all clients are given a personalised and dedicated attention is paramount.
• “Most people do not listen with the intent to understand; they listen with the intent to reply.” ― Stephen R. Covey
A client needs a good listening ear. This means understanding a client’s business, discussing various outcomes and scenarios, total focus on the client’s instructions and finding a practical solution.
• “The way to get started is to quit talking and begin doing”. – Walt Disney
Clients are interested in getting the work done efficiently and within an agreed time frame. Being pro-active on each matter leads to client satisfaction.
• “A man who dares to waste one hour of time has not discovered the value of life.” – Charles Darwin
When taking on clients having the right checklists, asking the relevant questions, obtaining adequate information and documentation from the onset avoids unnecessary waste of time.
• “It is not the strongest of the species that survives, nor the most intelligent that survives. It is the one that is the most adaptable to change.” – Charles Darwin
Technology is changing all professions and businesses. The legal profession is undergoing tremendous change when it comes to delivery of service. Adapting legal technology from the start of my practice has increased my survival in a tough legal market. Leveraging on legal technology and approaching a client’s work with empathy has led to a strong foundation for my practice.
What is store for the next 12 months.
I look forward to very exciting next 12 months. I will be continuing to serve my clients in the same zeal and developing my practice in the following areas.
• Data Protection Law.
The Kenya Data Protection Bill (the Bill) is going through the hoops to be legislated by the parliament in Kenya. The Kenya Data Protection Bill is based on the European General Data Protection Rules (GDPR). Once the Bill is implemented into law it will have serious ramifications for individuals and businesses of all sizes. The fines for non-compliance are heavy and up to Kenya shillings five million per breach.
Clients are advised to be compliant to avoid getting caught on the wrong side of the law when the Bill is enacted into law. The services we provide in the area of data protection are:
General advise on the Data Protection Bill.
Compliance issues for personal data.
Access rights for data subjects.
Employees and data protection.
Marketing and data protection.
Privacy Policies and notices for companies.
Children-related issues.
• Corporate Governance for small and medium sized companies.
Lack of a good corporate governance structure is one of the biggest challenges facing most companies in Kenya. Many family owned companies, which initially started with one duka (shop) decades back, have grown into giant corporates. Bad corporate governance structures eventually led to some of these companies’ downfall and insolvency.
I advise small and medium sized companies on good corporate governance structures. This will be based on the UK Quoted Alliance Code 2018 which is the appropriate code of governance for small companies.
Our advice on good corporate governance includes:
Composition of board of directors.
Appointment of non-executive directors.
Shareholders role in corporate governance.
Engaging with various stakeholders in the best interest of the company.
Compliance with the Companies Act 2015.
Setting of company’s objectives in the context of the social, regulatory and market environment.
